2. Scope

These terms apply to sales to consumers purchasing primarily for purposes outside their trade, business, craft or profession.

3. Products

AMAR.shop offers headphone headbands, replacement components, modification accessories and related audio accessories.

  • Compatibility information

  • Installation information

  • Price

  • Delivery estimate

4. Compatibility

Customers must verify that the selected product is compatible with their headphone model.

Where AMAR.shop expressly describes a product as compatible with a particular model, that compatibility forms part of the product description.

Third-party trademarks and model names are used only for identification. No commercial affiliation is implied unless expressly stated.

5. Prices

Prices are displayed in the currency shown on the website.

The applicable price is confirmed during checkout.

Where value-added tax is legally applicable and included, the displayed consumer price includes that tax unless clearly stated otherwise.

AMAR.shop provides free standard shipping on every order.

Any optional premium delivery charge will be displayed before the customer confirms the order.

6. Ordering Process

To place an order, the customer:

  1. Selects the products and available variations.

  2. Adds them to the cart.

  3. Reviews the cart.

  4. Provides billing and delivery information.

  5. Selects an available payment method.

  6. Reviews the order summary and total.

  7. Corrects any errors.

  8. Confirms the order and obligation to pay.

Customers must provide complete and accurate information.

7. Contract Formation

After submission, the customer receives an electronic acknowledgement.

The acknowledgement confirms receipt but does not necessarily constitute final acceptance.

The sales contract is formed when AMAR.shop accepts the order or confirms dispatch.

The contract is concluded in English. Customers should save the order confirmation and applicable policies.

8. Order Refusal

An order may be refused or cancelled for a legitimate reason, including:

  • Failed payment

  • Suspected fraud

  • Product unavailability

  • Unsupported destination

  • Materially incomplete information

  • Unlawful activity

  • An obvious pricing or technical error

If payment has been collected for an order that is not accepted, the amount will be refunded.

9. Payment

Available payment methods are displayed during checkout.

By submitting payment details, the customer confirms that:

  • The information is accurate

  • They are authorised to use the payment method

  • The payment provider may process the transaction

  • AMAR.shop may collect the confirmed total

10. Delivery

All orders qualify for free standard shipping without conditions.

The estimated delivery time is:

15–20 calendar days from order confirmation.

Customers must provide an accurate delivery address.

AMAR.shop remains responsible for proper performance of the consumer contract where required by law, including when a third-party carrier is used.

11. Late Delivery

If delivery does not occur within the agreed period, the customer may request performance within an appropriate additional period.

Where statutory conditions are met, the customer may cancel the contract and obtain reimbursement.

If delivery by a particular date was an essential condition, the customer may have the right to cancel without an additional period.

12. Risk

For consumer purchases, risk of loss or damage generally passes when the customer, or a designated third party other than the carrier, physically receives the goods.

13. Right of Withdrawal

A consumer generally has 14 calendar days after receiving eligible goods to withdraw without giving a reason.

The customer must send a clear request to:

BarrottShuter6901@outlook.com

The message should identify the customer, order, products, receipt date and withdrawal decision.

After notification, the products must be returned without undue delay and no later than 14 calendar days after communicating withdrawal.

14. Withdrawal Refunds

Following a valid withdrawal, AMAR.shop will reimburse the amounts received for the affected products.

Refunds will be made without undue delay and no later than 14 calendar days after notification, subject to the lawful right to withhold reimbursement until the products are received or evidence of dispatch is supplied.

The original payment method will normally be used.

Because standard shipping is free, no standard outbound delivery charge applies.

15. Return Costs

For a change-of-mind withdrawal, the customer bears the direct return cost.

AMAR.shop bears reasonable return costs where required by law, including for qualifying faulty, damaged, incorrect or non-conforming products.

16. Withdrawal Exceptions

The withdrawal right may not apply to legally excluded products, including:

  • Products made to customer specifications

  • Clearly personalised products

  • Sealed hygiene-sensitive goods after unsealing

  • Goods inseparably mixed with other items after delivery

  • Sealed software, audio or video products after unsealing

  • Eligible digital content supplied following valid consent and acknowledgement

Exceptions apply only when all legal conditions are met.

17. Legal Guarantee of Conformity

Consumers benefit from the legal guarantee of conformity under Articles L.217-3 and following of the French Consumer Code.

Products must:

  • Match their description

  • Possess agreed characteristics

  • Be fit for normal use

  • Include agreed accessories and instructions

  • Meet legitimate expectations concerning functionality, compatibility, durability and safety

For eligible new goods, the guarantee generally applies to a lack of conformity appearing within two years after delivery.

The consumer may normally request repair or replacement without cost.

Where the statutory conditions are met, the consumer may obtain a proportionate price reduction or cancellation of the contract and reimbursement.

18. Hidden Defects

Under Articles 1641 and following of the French Civil Code, the seller is liable for hidden defects that make a product unsuitable for its intended use or substantially reduce that use.

Where the legal requirements are satisfied, the customer may return the product for reimbursement or retain it and request a price reduction.

A claim must generally be brought within two years after discovery of the defect, subject to applicable law.

19. Installation

Customers should follow available instructions and use suitable tools.

A customer may not be entitled to a remedy for damage caused solely by:

  • Installation contrary to clear instructions

  • Excessive force

  • Use with an incompatible device

  • Accidental damage

  • Unauthorised alteration

This does not restrict rights arising from defective instructions, inaccurate compatibility information or a non-conforming product.

20. Complaints

Complaints should first be sent to:

BarrottShuter6901@outlook.com

Include:

  • Full name

  • Order number

  • Description of the dispute

  • Supporting evidence

  • Requested remedy

AMAR.shop will attempt to resolve the complaint amicably.

21. Personal Data

Personal data is processed for ordering, payment, delivery, customer service, legal compliance and other purposes described in the Privacy Policy.

Privacy requests may be sent to BarrottShuter6901@outlook.com.

22. Force Majeure

Neither party is liable for a failure caused by an event legally qualifying as force majeure under French law.

This section does not remove mandatory rights relating to cancellation, non-delivery or refunds.

23. Severability

If a provision is invalid or unenforceable, the remaining provisions continue to apply where legally possible.

A mandatory statutory provision replaces any incompatible term.

24. Governing Law and Jurisdiction

These Terms of Sale are governed by French law.

Consumers residing elsewhere in the European Union or European Economic Area retain applicable mandatory protections under the law of their habitual residence.

Consumers may bring proceedings before any court having jurisdiction under mandatory law.
